Practically Perfect Homes values honesty, trust, confidentiality, and transparency. This page explains how we handle information collected through our website and the terms that apply when you use our website.

For purposes of this page, “Practically Perfect Homes,” “PPH,” “we,” “us,” and “our” refer to Practically Perfect Homes. “Site” means www.practicallyperfecthomes.com and the pages and features available through it.

If you make a payment through an online payment service or other third-party payment provider, the provider may collect payment-card, bank-account, billing, or similar transaction information.

Practically Perfect Homes may receive information about the transaction, such as your name, billing information, payment status, amount paid, and transaction reference information. We do not need or intend to store complete payment-card numbers when those transactions are handled by a third-party payment processor.

5. How We May Share Information

We do not disclose personal information simply because someone asks for it. We may share information when reasonably necessary for our business or the services you request.

Depending on the circumstances, information may be shared with:

Website and Technology Providers

Companies that provide website hosting, analytics, forms, cloud storage, email, client portals, scheduling, electronic signatures, project-management tools, security, or other technology we use to operate our business.

Payment and Financial-Service Providers

Payment processors, banks, bookkeeping services, accounting providers, or similar companies involved in processing or documenting transactions.

Vendors and Project Service Providers

When necessary to perform requested services, we may share relevant information with vendors, manufacturers, delivery providers, receiving warehouses, installers, contractors, trades, photographers, or other service providers associated with a project.

We limit project-related disclosures to information we reasonably believe is needed for the applicable purpose.

Professional Advisors

We may provide information to attorneys, accountants, insurers, consultants, or other professional advisors when reasonably necessary to operate or protect our business.

Legal and Safety Purposes

We may disclose information when we reasonably believe disclosure is necessary to:

  • Comply with applicable law, regulation, court order, subpoena, or lawful governmental request;

  • Protect the rights, property, or safety of Practically Perfect Homes, our clients, Site visitors, or others;

  • Investigate suspected fraud, security incidents, or unlawful activity; or

  • Establish, exercise, or defend a legal claim.

Business Changes

If Practically Perfect Homes is involved in a merger, acquisition, sale, restructuring, financing, or transfer of some or all business assets, information may be disclosed as reasonably necessary to evaluate or complete that transaction, subject to appropriate confidentiality protections where applicable.

6. Sale of Personal Information

Practically Perfect Homes does not sell customer lists or personal information in exchange for money.

We do not knowingly sell sensitive personal data.

Some privacy laws use broad definitions of “sale,” “sharing,” or “targeted advertising” that may extend beyond an ordinary exchange of information for money. If our practices change in a way that requires additional notice, consent, or an opportunity to opt out under applicable law, we will take reasonable steps to provide the required notice or choice.

7. Marketing Communications

If you choose to receive marketing emails or similar communications from us, you may unsubscribe from marketing messages by using the unsubscribe instructions included in the communication or by contacting us.

Even if you opt out of marketing communications, we may still send service-related or transactional messages when reasonably necessary for an inquiry, appointment, project, purchase, payment, agreement, or ongoing client relationship.

8. Data Retention

We retain personal information for as long as reasonably necessary for the purposes for which it was collected and for legitimate business needs.

Retention periods may vary depending on the type of information and may take into account:

  • An active inquiry or client relationship;

  • Insurance requirements;

  • Warranty or vendor matters;

  • Recordkeeping needs;

  • Potential or actual disputes;

9. Data Security

We use reasonable administrative, technical, and organizational measures intended to protect personal information from unauthorized access, loss, misuse, alteration, or disclosure.

No website, email system, cloud service, electronic transmission, or data-storage system can be guaranteed to be completely secure. For that reason, we cannot promise absolute security.

You can also help protect your information by avoiding the transmission of highly sensitive information through ordinary email or general website forms unless specifically requested.

10. Your Privacy Choices and Requests

Depending on where you live and the laws that apply to the particular information, you may have rights regarding your personal information.

These may include rights to request access to, correction of, or deletion of certain personal information or to obtain information about certain data practices.

Please include enough information for us to understand and reasonably verify your request. We may request additional information when reasonably necessary to verify identity, protect another person's privacy, or determine whether a request applies under applicable law.

We may retain information when permitted or required for legitimate purposes such as completing a transaction, maintaining required business records, complying with law, detecting security incidents, resolving disputes, exercising legal rights, or fulfilling contractual obligations.

If applicable law gives you a right to appeal a decision concerning a privacy request, you may reply to our decision or email us with the subject line “Privacy Appeal.”

We will not discriminate against someone for exercising a privacy right provided by applicable law.

11. Children's Privacy

Our Site and services are intended for adults and are not directed to children under 13.

We do not knowingly collect personal information online directly from children under 13 without appropriate authorization. If you believe a child under 13 has provided personal information to us through the Site, please contact us so we can review the situation and take appropriate action.

Individuals under 18 should not submit a service inquiry, enter into an agreement, or make a purchase through the Site without the involvement of a parent or legal guardian.

12. Third-Party Websites and Services

Our Site may contain links to, integrations with, or features provided by third-party websites, social-media platforms, scheduling providers, client portals, payment services, vendors, or other companies.

Once you leave our Site or interact directly with a third-party service, that provider's privacy practices and terms may apply.

Practically Perfect Homes does not control the privacy, security, availability, content, or business practices of independent third-party websites and services.

We encourage you to review the applicable privacy policy before providing personal information directly to a third party.

13. Changes to This Privacy Policy

We may update this Privacy Policy when our practices, technology, services, or legal obligations change.

When we update it, we will revise the “Last Updated” date shown at the top of this page. If a change materially affects how we handle previously collected information and additional notice or consent is required by law, we will provide that notice or obtain consent as required.

WEBSITE TERMS OF USE

1. Acceptance of These Terms

These Website Terms of Use (“Terms”) apply to your access to and use of www.practicallyperfecthomes.com.

By accessing or using the Site, you acknowledge these Terms.

If you do not agree with these Terms, please discontinue use of the Site.

Nothing in these Terms limits rights or remedies that cannot legally be waived or limited.

2. Website Information Is Not a Client Service Agreement

The Site provides general information about Practically Perfect Homes, our services, portfolio, design approach, professional organizing services, process, and related topics.

Visiting the Site, submitting an inquiry, communicating with us, or requesting information does not by itself create a designer-client, organizer-client, professional, fiduciary, agency, or other service relationship.

A client relationship begins only when Practically Perfect Homes accepts the engagement and any required agreement, proposal, scope of work, payment, or other authorization has been completed.

Actual interior design, professional organizing, consultation, procurement, purchasing, installation, and other client services are governed by the applicable agreement, proposal, scope of work, invoice, change order, booking terms, or other written client documentation.

If these Website Terms conflict with a signed or otherwise properly accepted client agreement regarding services, the client agreement controls with respect to those services.

3. Service Descriptions, Pricing, and Availability

We make reasonable efforts to keep information on the Site helpful and current. However, services, service areas, scheduling availability, processes, pricing, minimum investments, estimated costs, photographs, examples, and other website information may change.

Website content is provided for general informational purposes and does not constitute a binding proposal, estimate, quote, guarantee, or promise that we will accept a particular project.

Specific pricing, scope, deliverables, payment terms, cancellation terms, schedules, procurement terms, and other project requirements will be established in the applicable client documents.

4. Cancellation and Refund Terms

Cancellation, rescheduling, refund, deposit, design-fee, product-purchase, and similar terms vary depending on the service or transaction.

The terms contained in the applicable consultation booking, proposal, service agreement, invoice, purchase approval, or other project document will control.

Please contact hello@practicallyperfecthomes.com if you have a question about the terms that apply to a particular booking, service, or purchase.

5. Portfolio, Photographs, Testimonials, and Examples

Our Site may include photographs, renderings, layouts, organizing projects, testimonials, portfolio images, design examples, descriptions of completed work, or other examples.

These materials are intended to demonstrate our style, experience, or the types of services we may provide. They are not a promise or guarantee that another project will have the same cost, schedule, appearance, result, functionality, product availability, or outcome.

Homes, clients, project conditions, budgets, existing architecture, product availability, trades, and individual preferences differ from project to project.

Renderings, mood boards, layouts, drawings, and similar images displayed on the Site are illustrative and should not be treated as architectural, engineering, structural, construction, permitting, or code-compliance documents.

6. No Architectural, Engineering, Construction, Legal, Financial, or Other Licensed Advice

Website content relating to homes, layouts, products, organization, renovations, decorating, materials, furnishings, or similar subjects is provided for general information and inspiration.

Unless expressly stated in a separate written agreement, Practically Perfect Homes is not providing architectural, structural-engineering, mechanical-engineering, electrical-engineering, plumbing, construction-management, legal, tax, financial, medical, mental-health, appraisal, or other licensed professional advice through the Site.

Information on the Site should not replace advice, verification, permits, inspections, measurements, calculations, or approvals required from an appropriately licensed or qualified professional.

7. Website Accessibility

Practically Perfect Homes is committed to making our website accessible and usable for as many people as possible, including people with disabilities. Accessibility is an ongoing effort, and we continue to evaluate and improve the website as technology, content, and accessibility practices evolve.

For more information about our accessibility efforts, or to report an accessibility barrier, please review our Accessibility Statement.

If you have difficulty accessing any part of the Site, please contact us at hello@practicallyperfecthomes.com or (903) 380-5115. We will make reasonable efforts to address the issue and, when appropriate, provide the requested information or service through an accessible alternative.

Certain content, applications, or services available through the Site may be provided by third parties that Practically Perfect Homes does not control. While we encourage third-party providers to support accessibility, their accessibility practices and technology are their responsibility. If you experience difficulty with third-party content accessed through our Site, please contact us so we can make reasonable efforts to assist you.

8. Intellectual Property

Unless otherwise identified, the Site and its original content—including text, branding, logos, graphics, photographs, layouts, designs, written materials, downloads, graphics, and other content created by or for Practically Perfect Homes—are owned by Practically Perfect Homes or used with permission and are protected by applicable intellectual-property laws.

You may access and view Site content for your personal, noncommercial use.

Without our prior written permission, you may not:

  • Copy or reproduce substantial Site content;

  • Republish Site content as your own;

  • Sell, license, distribute, or commercially exploit Site content;

  • Remove copyright, trademark, attribution, or proprietary notices;

  • Create derivative commercial materials from our original content;

  • Use our photographs, designs, graphics, written materials, or branding to promote another business; or

  • Use automated tools to systematically scrape, harvest, copy, or republish Site content except as permitted by applicable law.

You are welcome to share a direct link to a publicly available page of our Site.

Nothing in these Terms transfers ownership of Practically Perfect Homes intellectual property to you.

9. Information and Materials You Submit

When you submit an inquiry, photograph, drawing, floor plan, measurement, document, message, or other material through the Site, you represent that you have the right to provide that information to us.

You retain any ownership rights you otherwise have in materials you submit.

You authorize Practically Perfect Homes and the service providers we use to receive, store, review, reproduce, transmit, and use submitted materials as reasonably necessary to:

  • Respond to your inquiry;

  • Evaluate a potential project;

  • Prepare requested information or proposals;

  • Provide services you later authorize;

  • Maintain business records; and

  • Operate and protect our business.

Submitting material through the Site does not give Practically Perfect Homes permission to publish your private project materials for marketing. Any marketing or portfolio use of client photographs or project information will be governed by the applicable client agreement or separate permission.

10. Acceptable Use

You agree not to misuse the Site.

You may not knowingly:

  • Use the Site for an unlawful, fraudulent, deceptive, abusive, or malicious purpose;

  • Attempt to gain unauthorized access to the Site, accounts, systems, servers, or data;

  • Introduce malware, viruses, harmful code, or disruptive technology;

  • Interfere with Site operation or security;

  • Impersonate another person or misrepresent your identity or authority;

  • Use automated systems to overload, scrape, copy, or interfere with the Site in a manner not permitted by law;

  • Circumvent security or access controls; or

  • Use Site content in a way that infringes another person's intellectual-property, privacy, or other legal rights.

We may restrict or block Site access when reasonably necessary to protect the Site, our business, other users, or our rights.

11. Third-Party Links, Platforms, Products, and Services

The Site may contain links to or integrations with third-party websites, social-media platforms, scheduling systems, client portals, payment processors, product vendors, manufacturers, trades, service providers, or other independent companies.

A link or reference does not necessarily mean that Practically Perfect Homes controls, guarantees, or endorses every aspect of the third party or its services.

Third parties are responsible for their own websites, products, services, policies, security, accessibility, pricing, availability, performance, and conduct.

Your use of a third-party site or service may be governed by that provider's own terms and privacy policy.

12. Website Availability and Security

We make reasonable efforts to maintain the Site but do not guarantee that it will always be uninterrupted, error-free, secure, current, or available.

The Site may occasionally be unavailable because of maintenance, hosting issues, software updates, internet outages, cybersecurity events, third-party services, or other circumstances outside our reasonable control.

We may change, suspend, remove, or discontinue Site content or functionality when reasonably necessary.

13. Disclaimer of Website Warranties

To the fullest extent permitted by applicable law, the Site and its content are provided on an “as available” and “as is” basis for general informational purposes.

Practically Perfect Homes does not warrant that:

  • Every statement on the Site will always be complete, current, or error-free;

  • The Site will operate without interruption;

  • The Site will be free from every security vulnerability or harmful component;

  • A particular service, product, vendor, trade professional, material, price, or schedule will be available; or

  • Use of website information will produce a particular result.

This disclaimer applies only to the Site and does not replace any express obligations Practically Perfect Homes undertakes in a separate client agreement.

Nothing in these Terms excludes warranties or protections that cannot legally be excluded.

14. Limitation of Liability for Website Use

To the fullest extent permitted by law, Practically Perfect Homes and its owners, employees, representatives, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising solely from access to, reliance on, or inability to use the Site.

This may include, where permitted by law, loss of data, lost profits, business interruption, or similar indirect losses arising from website use.

To the fullest extent permitted by law, Practically Perfect Homes' total aggregate liability arising solely from use of the Site will not exceed $100.

This limitation applies to claims arising from the Site itself and does not replace or modify a limitation of liability contained in an applicable client service agreement.

Nothing in these Terms limits liability that cannot legally be excluded or limited.

15. Indemnification for Misuse of the Site

To the extent permitted by law, you agree to be responsible for third-party claims, losses, or reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Site;

  • Content you submit without the necessary rights or permission;

  • Your infringement of another person's intellectual-property or privacy rights; or

  • Your intentional violation of these Terms.

This provision does not require you to indemnify Practically Perfect Homes for claims caused by our own negligence, willful misconduct, or liability that cannot legally be shifted to another party.

16. Electronic Communications

When you contact us electronically, you agree that we may respond electronically using the contact information you provide.

Electronic communications may include inquiry responses, proposals, approvals, confirmations, invoices, scheduling messages, service communications, and other business records.

This provision does not by itself constitute consent to receive promotional text messages or marketing emails where separate consent is required by law.

17. Dispute Resolution

We believe most concerns can be resolved through clear communication.

Before beginning formal proceedings relating to these Website Terms, the parties agree to first make a reasonable good-faith effort to resolve the dispute through direct written communication.

If the dispute is not resolved through direct communication, the parties agree to attempt good-faith mediation in Titus County, Texas, or remotely by mutual agreement, before proceeding to arbitration, unless immediate temporary court relief is reasonably necessary to protect intellectual-property, confidentiality, security, or similar rights.

Binding Arbitration

If mediation does not resolve the dispute, then, to the extent permitted by law, a dispute arising out of or relating to these Website Terms or use of the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under the rules applicable to the nature of the dispute.

The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision where applicable.

Arbitration may be conducted remotely. Any required in-person arbitration proceeding will take place in Titus County, Texas, unless the applicable arbitration rules or law require otherwise.

Either party may bring an individual claim in small-claims court if the claim qualifies and remains in that court.

The arbitrator's decision will be final and binding, and judgment on the award may be entered in a court with jurisdiction.

Arbitration fees will be allocated according to the applicable arbitration rules. Each party will bear its own attorney's fees and costs unless the arbitrator awards fees, another agreement provides otherwise, or applicable law permits or requires a different result.

Jury Trial and Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. ARBITRATION MEANS THAT, FOR CLAIMS SUBJECT TO ARBITRATION, THE PARTIES GENERALLY GIVE UP THE RIGHT TO HAVE A JUDGE OR JURY DECIDE THE DISPUTE IN COURT.

To the fullest extent permitted by law, arbitration will take place only on an individual basis.

Neither party may bring or participate in a class, collective, consolidated, or representative action against the other with respect to a claim required to be arbitrated, unless applicable law provides that the particular right cannot be waived.

An arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that party's individual claim.

If a court determines that a particular claim or request for relief cannot legally be arbitrated or subjected to the class-action waiver, that claim or request will proceed as required by applicable law, while the remainder of this section will remain effective to the extent permitted.

18. Governing Law and Court Venue

These Website Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where federal law or another applicable law controls.

Subject to the Dispute Resolution section above, any court proceeding arising from these Terms or use of the Site will be brought in a court of competent jurisdiction in Titus County, Texas, unless applicable law requires otherwise.

19. Separate Client Agreements Control

These Terms govern use of the Site.

They do not replace an Interior Design Services Agreement, Professional Organizing Services Agreement, consultation agreement, proposal, Scope of Work, Change Order, invoice approval, product authorization, or other client agreement.

When a separate agreement applies to services or a transaction, that agreement controls the matters it specifically addresses.

20. Changes to These Terms

We may update these Terms as our Site, business, technology, or legal requirements change.

The version posted on the Site with the most recent “Last Updated” date will apply prospectively from that date.

Material changes will not retroactively alter a signed client agreement unless the client agreement itself permits the change or the parties otherwise agree in writing.

21. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will continue in effect.

22. No Waiver

If Practically Perfect Homes does not immediately enforce a provision of these Terms, that does not mean we waive the right to enforce it later.

23. Entire Agreement Regarding Website Use

These Terms and the Privacy Policy above constitute the understanding between you and Practically Perfect Homes regarding use of the Site itself.

They do not supersede a separate agreement governing paid services, products, consultations, or projects.
